Consumer Law Essay Example
Customer Law Essay The most helpful word reference meaning of a customer is somebody who purchases merchandise and ventures for individual use or need (Chambers 21st Century Dictionary). All buyer exchanges depend on the law of agreement. The purchaser consents to buy products or administrations and the merchant consequently give those merchandise or administrations. Each trade of products is an understanding between the purchaser and dealer in this way making them dependent on the law of contact. The significant demonstration that supports and helps shoppers is the Sale of Goods Act 1979 (SGA), as altered by the Sale and Supply of Goods Act 1994 and Supply of Goods to Consumers Regulations 2002. The Sale of Goods Act covers exchanges where merchandise are moved for money related thought, called the price(Nutshells p. 1). Over the span of this article I will be taking a gander at the applicable Acts so as to build up how the law tries to secure the shopper. In the light of the inquiry, by taking a gander at the helpful word reference definition and the definition gave by the significant resolutions, which expresses that a buyer is a characteristic individual going into an agreement with another throughout business we can see that Lil obviously fits the meaning of a shopper by meeting both the definitions set out. We will compose a custom article test on Consumer Law explicitly for you for just $16.38 $13.9/page Request now We will compose a custom article test on Consumer Law explicitly for you FOR ONLY $16.38 $13.9/page Recruit Writer We will compose a custom exposition test on Consumer Law explicitly for you FOR ONLY $16.38 $13.9/page Recruit Writer So as to continue we should now characterize the merchant and being throughout business. This expression can be utilized in both common and criminal law and the courts in connection have attempted to keep the importance same across the two segments, RB Customs Brokers Co Ltd v. joined Dominion Trust Ltd (a common case) which followed the direction in Davies v. Summer (a criminal case). According to our situation as the merchandise, which for this situation is the shoes, are moved for a money related thought, the deal is administered by the Sale of Goods Act 1979. Under this Act the inferred terms set out by S. 14 possibly apply when the products are sold throughout business with the exchange being an indispensable piece of the business, with some level of normality and in the idea of exchange and did with the end goal of making a benefit, this can be found on account of Stevenson v. Rogers (1999). This segment doesn't cover any private deals and there is a special case where the deal is done as a side interest, with no critical benefit being made. In the light of our situation we can unmistakably name Tuffstuff as the dealer and acting throughout business on the grounds that the merchandise (shoes) where sold inside the store where exchange is a basic piece of their business. There is a level of normality since they are continually over the span of business selling shoes along these lines being in the idea of exchange with the end goal of making benefit from their deals. Since I host recognized the gatherings to the substantial agreement I will be taking a gander at the terms inferred by the Sale of Goods Act 1979. Segments 12,13,14 and 15 of this Act infer terms into contracts for the offer of merchandise. The basic issue here is whether the products (shoes) where fit for their motivation. Segment 14 (3) of the SGA 1979 states that the vender sells products a specific reason for which such merchandise are normally provided (P. 11 Unit Guide). By utilizing and applying this standard to the realities of the case we can see that reason for the merchandise are basic. This is to state whether the design is one for which such merchandise are ordinarily provided and utilized for or one that the shopper has utilized it for. The reason could be made known by suggestion where the motivations behind the products being referred to are self-evident, e. . a boiling water bottle on account of Preist v. Last 1903 (Consumer Law P. 45). Comparable to our case realities we don't have the foggiest idea what sort of shop the buyer brought the shoes from or the kind of shoes theyve acquired detail, we can just depend on the announcement made by the shop director which expresses that the shoes were not planned for use on rough territory. It is expressed that buyers every now and again get one-reason products where no exhortation is taken from the vender with respect to the merchandise on the grounds that the object is suggested being just one-reason merchandise henceforth breaking S. 14 (2) and 14(3) if the products are flawed. According to multi-reason products the purchaser is encouraged to pose whatever number inquiries as could be expected under the circumstances about the merchandise and what they can utilize it for so as to profit under S. 14 (3). This can be found on account of Griffiths v. Subside Conway Ltd 1939 where the purchasers skin condition was not imparted to the vender in this manner there was no penetrate of S. 14 (2) or S. 14 (3). On the off chance that in cases, for example, this the purchaser doesn't impart what they mean to utilize the merchandise for, other then their ordinary reason, at that point the degree of the merchants commitment is to guarantee that the products are fit for what their unique object is for (Jewson Ltd v. Kelly 2003). In the light of our situation we can see that the buyer utilized the shoes on a slope strolling occasion. The shoes are one-reason merchandise and are not expected for explicitly to be utilized on tough territory, as the retailer sensibly accepted. There was no correspondence among Lil and the dealer before the deal in regards to if the shoes could be utilized for slope strolling, in the event that anyway Lil posed numerous inquiries and assembled data with respect to the products, at that point she could have the most extreme advantage under S. 14 (3). Area. 14 SGA infers that products must be of agreeable quality. So as to prompt Lil on her authoritative rights it is essential to comprehend this area of the Act. In any case, the point here respects the quality and wellness of the item in concern. Area. 14 (2) expresses that Where the merchant sells merchandise. provided are of acceptable quality. So as to proceed onward we should comprehend what acceptable quality methods. Before 1994 the test was to check whether the merchandise were of merchantable quality. This was later supplanted by the trial of palatable quality. The requirement for this change was featured on account of Bernstein v. Pamson Motors (1987) (Consumer Law P. 45). The wording of the SGA 1979 was revised with the death of SGA Amendment Act 1979 which currently expresses that products are of palatable quality in the event that they fulfill the guideline that a sensible individual would see as good (P. 11 Unit Guide) assessing any portrayal of the merchandise, the cost and all other important conditions (s. 14 (2a)). Additionally s. 14 (2b) states that nature of products incorporate their state or condition and 5 different focuses (A. Qualification for all usually provided, B. appearance and finish, C. opportunity from minor deformities, D. wellbeing and E. strength (P. 11 Unit Guide)). In the light of our case focuses A, D and potentially E obviously apply as pertinent and should be considered on the grounds that the other 2 quality focuses can be viewed as satisfied by the merchant. The shoes bought by the purchaser were not strong and had self-destructed making them unwearable which could be dangerous for the shopper. The way that the shoes were not solid could mean they are not of palatable quality under the SGA 1979. The instance of Bernstein v. Pamson Motors (1987) could be valuable under the strength segment. The inquiry we have to pose is to what extent we anticipate that new products should last? From the Act this is difficult to make sense of on the grounds that the definition states solidness is a factor however doesn't give any additional data so it is helpful to take a gander at the realities of each case so as to decide toughness of new products. In the Bernstein case Rougier J. held that the vehicle brought was not merchantable quality since you would expect purchasing another vehicle the motor would not seize up following three weeks. In todays case the vehicle would not be one of acceptable quality. Before we reach a strong resolution with respect to Lils authoritative rights and any cures, which may exist, another issue raises. Terms in S. 13, 14 (2) and 14 (3) are for the most part conditions. Their significance is crucial as purchasers are concerned in light of the fact that they can influence the cures they can seek after. Anyway S. 11 (4) of the SGA calls attention to that where an agreement of offer isn't severable to be treated as a penetrate of guarantee (Nutshells P. 14). The issue is whether there is proof of acknowledgment of the products, which influences the kind of cure the purchaser, is qualified for guarantee. Areas 34 and 35 of the SGA administrate acknowledgment and S. 35 proclaim that acknowledgment can happen in three different ways. 1) By hint to the vender that is to state verbally telling the dealer that you acknowledge the great 2) by a demonstration after conveyance conflicting with the merchants possession 3) through maintenance past a sensible time (Consumer Law and Practice P. 110-12). Regarding our situation the last technique for acknowledgment (number 3) is definitive. The inquiry we have to pose is when does the time begin to run and what is viewed as sensible? The central instance of Bernstein v Pamson Motors (1987) where it was held saving the vehicle being referred to for three weeks established to acknowledgment, which implied the purchaser, was qualified for a fair cure just (Nutshells P. 15). Anyway this case was seen not to be beneficial to buyers and the alterations imply that the law is presently more for the customer. The Court of Appeal as of late held that Bernstein was not, at this point great law. On account of Clegg v. Olle Andersson (2003) the point behind S. (5) had been accomplished and that the purchaser could dismiss his yacht significantly following seven months (Consumer Law and Practice P. 113) Nevertheless having ownership of products past sensible timeframe still establishes acknowledgment yet sensibility is an issue of truth and the issue of having sensible time to look at the merchandise must be thought of. According to our situation and the case realities the inquiry we have to

The Tragedy Of Othello By William Shakespeare - 1737 Words
The Tragedy of Othello the: Moor of Venice was written by William Shakespeare, and it is only one of countless notable plays he wrote. A reoccurring theme in Othello is jealousy brought on usually by deception; throughout the play people often hide their true intentions and are not always what they appear to be like W.H Auden said ââ¬Å"There s always another story. There s more than meets the eye.â⬠The relationships Iago built on manipulation, lies, and false promises were a crucial part of the play; Iago was able to deceive other characters by twisting the situation so that characters like Roderigo, Cassio, and Othello misinterpreted what they saw. However, he was not the only one to put up a front in Othello; Emilia also put up a faà §ade when claiming to be Desdemonaââ¬â¢s friend. Supply Chain Management And Logistics - Free Sample
Question: Write a report on Hyundai Motors supply chain management. Answer: Introduction This report is on Hyundai Motors supply chain management. An analysis has been done on the product flow, information flow and cash flow from a managers perspective. Also by referring to various sources, we have also analyzed its production planning that includes planning for raw material and scheduling process. Mapping its efficiency and loopholes, we have also suggested ways of improvement by applying concepts of supply chain and its theories. Also we have gone through, different forecasting models and selected the one which is best suited for it. The Hyundai Motors is a South Korean Company with its headquarters in Seoul. It is a automotive company and was founded in 1967 along with its subsidiary, Kia Motors. Together they make Hyundai Motor Group. Currently it is ranked 4th largest automobile manufacturer in the world. It has many plants in Korea and in many other countries worldwide. Its largest plant is in Ulsan (Korea) with 5 manufacturing plants and transmission plants (Hyundai motor Company, 2016). It also has test and crash test sites. It has 2 more sites Asan plant and Jeonju Plant. Its other plants include plants in Alabama , China, India , Czech , Turkey, Russia and Brazil. In 2015, its yearly sales of vehicles were 1,867,166 (both domestic and international). Its employees are more than 75000 and its vehicles are sold in more than 193 countries through more than 6000 showrooms and dealers (Seok, 2015). For research and development, it has 6 centres worldwide (three in Korea and rest in India, Germany and Japan). T he company started developing flexible fuel vehicles in 1988. In 1991, it developed its first electric car. It started with manufacturing hybrid cars in 1995. Hyundai also participated in World Rally Championship in 1998 and 1999. Its famous models include Accent, Verna, Sonata, Coupe, Dynasty, Pony, Lavita, Stellar, Terracan, Entourage, Galloper, Trajet, Veracruz/ix55. The Key Flows in Supply Chain In order to beat the competitive environment, companies thrives on efficient supply chain management that includes that include the flow of raw materials from suppliers to end users, information flow from the manufacturer to the consumer offer, purchase, dispatch, invoice etc. Cash flow is also part of it where cash flow is also observed from the customer to the manufacturer. Efficiency in all the three is required to get maximum productivity from the given resources. Hyundai has many suppliers (that include many first tier suppliers, 2nd tier supplier, 3rd tier and higher as well) that are domestic and international. Its sales and independent dealer have only vehicle models and dont carry any inventory. This helps it to quickly handle customer demands with low expenditure. It has a specific delivery time period for domestic vehicles and slightly longer period for international deliveries (Hahn, Duplaga, Hartley, 2000). They try to keep minimum inventory and also maintaining lead time. In order to achieve this goal, they rigorously watch production schedules and coordinate with client deliveries. This task is not very easy and conflicts/ problems keep coming up from time to time. So to resolve it, Hyundai made production and sales control department (Duplaga Hartley, 2000). This department helps to synchronize, balance customer requests and deal with excess or shortages. But, this department also faces issues as follows: Production and sales requirement not always meet, due to limited production capacity. Domestic and international sales managers have to compete to meet the delivery deadlines. Wherever there is a change in the production schedule, it leads to shortage or over supply of inventory. Changes in the current design or new product addition, arise lot of coordination issues (Ethical Consumer Research Association Ltd., 2015). Hyundai is using a system called order launching and delivery sequencing to enhance its productivity, which requires managers to coordinate between delivery deadlines and production schedules. Recommendations: Optimizing various resources: costs can be reduced by efficiently using the plant space, so that the fixed cost of the company can be used. In the same way machines optimization can be done by maintaining it and its schedule. In this way its maintenance cost and downtime can be reduced. Logistics can also be optimized by checking the packing, storing items and disposing waste. From the waste things that can be recycled can be checked that can further reduce the cost. Managing Information Flow: information system of any organization should be capable of collecting and sorting the large amount of data, analyzing it to make its information, foresee the future needs on the basis of information and it should also help to track the productivity. So, Hyundai should foster its information system, so that it can make better use of it. The Make Process Hyundais management gets most of its tasks related to planning, sales, resolving conflicts and coordinating various departments by its production and sales control department. Suppliers are not involved in the production plannings but they are informed of the planning process by a network called EDI system. The Production and sales control department faced many problems like planning process was not defined due to which there were lots of issues related to production planning and coordination. Also, since this was the new department, so they were not lacking any experience and the kind of rules and policies required to run the department (Siemens Product Lifecycle Management Software Inc., 2016). Lack of training was the other issue that they were facing to solve daily problems and handle conflict Moreover, managing information flows were also one of the problems because Hyundai was not having a common database to link different groups. Therefore, in the starting the department had to gather data from various sources and develop the plans. The department had to bring together data from the different functional groups. Then the staff members use to make the master production schedules. Due to all this work, staff members were left with very little time to look into other issues (Hyundai Team, 2016). Also, there were many rapid changes happening in the global environment due to which the pattern of demand was beyond expectation. During 1990s, Hyundai launched its new model Sonata in Korea and its demand increased explosively. The production department was not ready to cope with such a huge demand in the given time due to which lead time was extended to 5 months which became a concern for sales department. This resulted in conflicts and lack of coordination between different departments (HMMA Team, 2016). There are many behavioral problems that the organization had to face. As an impact of the above mentioned problems, there were many changes in the formulated policies and plans. This caused lots of confusion which ended up in frustration. Preliminary meeting: A behavioral problem issue was taking responsibility. To be effective, final production plans must be based on accurate planning data, such as sales forecasts, available capacity, and materials plans. The responsibility for developing and providing these data rests with the involved departments. However, as the representatives of the various areas developed the final plan through the process of compromise, some participants tried to make the P/SC meeting or department responsible for developing and providing the best data. This problem probably arose out of the participants frustration when their best estimates were revised as part of the compromising process. Closely related to this problem was that of departmental representatives concentrating on supporting their departmental positions. This meant that the final decision was sometimes determined by force of personality instead of logic. Few recommendations on the above listed problems are given below: Supply chain Management training: Training is very essential to the employees of the organization in order to get best out of them. Only if they are trained that they know what to do and how to do smartly. Needs and demands are changing regularly, so employees should be updated with current knowledge to beat the global competition. Integrating processes of logistics with suppliers: it is important to integrate the logistic process with the suppliers, using certain softwares like ERP. This will help the customer to have a better understanding of the customers inventory so that any changes that the suppliers need to plan, they can do them by checking the inventory to get realistic goals and plans. The Supply Chain Forecasting Once the manager and the forecaster have formulated their problem, the forecaster will be in a position to choose a method. There are three techniques that are used Causal models. Time series analysis and projection Qualitative techniques Causal Method: The first method is named so because it uses cause and effect relationship between the demand and factors causing it. The factors can be prices, availability of raw material etc. it is a bit complex method, but quite reliable than other two. This can also take past trends and connect them with different variable to forecast for future. It include: Regression Analysis Autoregressive moving average with exogenous inputs Qualitative Techniques: It uses qualitative data and is based on the discretion of experts, consumers etc. It is mainly used when any past data is not available or something that is done for the first time. (Zhou Gu, 2014). Time series analysis and projection: there are various methods to use this method: Linear prediction, moving average, trend estimation, extrapolation, exponential smoothing, growth curve, etc. it mainly uses past data, analyze it to estimate future outcomes from it (Chambers, Smith, Mullick, 1971). The best model to forecast Hyundai Motors is Causal Model. Since its a very old company now and has lots of data not only from its domestic sale but also international sale as well. This data can help a lot to give global trend with respect to different scenarios. For example, it has a sale data of many countries, some of which are underdeveloped, developing or developed. So over the years under what circumstances, sales decrease or increase and the effect of competition can give a lot of information that a novice will take years to have. Many factors such as related businesses, economic changes, social environment and stability and safety of a country are the factors that a person can use which doing causal method. This method can also use time series analysis and consider mathematically the relevant causal relationships. The causal model also takes predictions of important events, promotions of different locations in case data is available. It will connect them with methamatical equations to give the final product flow chart. (Ferrari, 2011) Conclusion In the above report, we have studied about a Korean multinational company Hyundai Motors. It is ranked 4th largest automobile manufacturer in the world. It has many plants in Korea and in many other countries worldwide. With the change in business environment, it adapted to the changes of supply change management where it integrated lot of processes to coordinate between supply and production. They try to keep minimum inventory and also maintaining lead time. In order to achieve this goal, they rigorously watch production schedules and coordinate with client deliveries. This task is not very easy and conflicts/ problems keep coming up from time to time. So to resolve it, Hyundai made production and sales control department. This department helps to synchronize, balance customer requests and deal with excess or shortages. But, this department also faces issues like production, shortage and excess supply etc. we have also discussed its planning and scheduling processes where they keep the information track of the client orders, maintain inventory, planning delivery and then final dispatch. Their coordination and loopholes are discussed. Finally we have gone through some forecasting techniques and concluded that causal method is best suited to forecast for Hyundai Motors, due to ample data available since its not new in market, having insights of trends and patterns over the years. Gray Wolf Facts
Gray Wolf Facts The gray wolf (Canis lupus) is the largest member of the Canidae (dog) family, with a range extending through Alaska and parts of Michigan, Wisconsin, Montana, Idaho, Oregon, and Wyoming. Gray wolves share their ancestry with domestic dogs, coyotes, and wild dogs such as dingoes. Scientists consider the gray wolf to be the species from which most other wolf subspecies evolved. The gray wolf is classified as part of the kingdom Animalia, order Carnivora, family Canidae,à and the subfamily Caninae. Fast Facts: Gray Wolves Scientific Name: Canis lupusCommon Name(s): Gray wolf, timber wolf, wolfBasic Animal Group:à Mammalà à Size: 36 to 63 inches; tail: 13 to 20 inchesWeight: 40ââ¬â175 poundsLifespan: 8ââ¬â13 yearsDiet:à CarnivoreHabitat:à Alaska, northern Michigan, northern Wisconsin, western Montana, northern Idaho, northeast Oregon, and theà Yellowstoneà area of WyomingPopulation:à 17,000 in the United StatesConservationà Status:à Least Concern Description Gray wolves look very much like large German shepherd dogs, with pointed ears and long, bushy, black-tipped tails. Wolf coat colors vary from white to gray to brown to black; most have a mix of colors with tan facial markings and undersides. Northern wolves are often larger than southern wolves, and males are usually larger than females. Jim Cumming/Getty Images Habitat and Distribution Gray wolves were once found in large numbers throughout the Northern Hemisphere- in Europe, Asia, and North America. At one time or another, gray wolves have ranged across nearly every type of environment found north of the equator from deserts to tundra, but they were hunted to near extinction wherever they were found. In the ecosystems they inhabit, wolves are a keystone species: They have a large influence on their environment despite their low abundance. Gray wolves exert control on their prey species, changing the numbers and behavior of large herbivores like deer (which is now overabundant in many places), thus ultimately affecting even the vegetation. Because of that important role, wolves hold a central place inà rewilding projects. The gray wolf is an extremely adaptable species and is one of those animal species that survived the last ice age. The gray wolfs physical characteristics enabled it to adapt quickly to the harsh conditions of the ice age, and its cunning and adaptation helped it survive in the changing environment. Diet Gray wolves typically prey on large ungulates (mammals with hooves) such as deer, elk, moose, and caribou. Gray wolves also eat smaller mammals such as hares and beavers as well as fish, birds, lizards, snakes, and fruit. Wolves are also scavengers and will eat the flesh of animals killed by other predators, by motor vehicles, and so on. When wolves find ample food or hunt successfully, they eat their fill. A single wolf may consume as much as 20 pounds of meat in a single feeding. Behavior Gray wolves are social animals. They usually live and hunt in packs of six to 10 members and often range over long distances- up to 12 miles or more- in a single day. Typically, several members of a wolf pack will hunt together, cooperating to pursue and bring down large prey. Wolf packs follow a strict hierarchy with a dominant male and female at the top. The Alpha male and female are usually the only two wolves in the pack that breed. All of the adult wolves in the pack help to care for the pups by bringing them food, instructing them, and keeping them from harm. Gray wolves have a complex system of communication that includes a wide range of barks, whines, growls, and howls. Their iconic and legendary howl is one way that gray wolves communicate with each other. A lone wolf may howl to attract the attention of his pack while wolves in the same pack may howl together to establish their territory and declare it to other wolf packs. Howling may also be confrontational or may simply be an answering call to the howls of other wolves nearby. Andyworks/Getty Images Reproduction and Offspring Most wolves mate for life, breeding once a year between January and March (or earlier in the south). The gestation period is about 63 days; wolves usually give birth to between four and six pups. Wolf mothers give birth in a den (typically a burrow or cave), where they can oversee the welfare of tiny pups which are born blind and weigh only about one pound. She will move the pups several times during the first few months of their lives. To feed their young, wolves regurgitate their food until the pups are old enough to manage meat on their own. Young wolves stay with their natal pack until they are about three years old. At that point, they make the decision to either stay with their pack or strike out on their own. Enn Lià Photography/Getty Imagesà Conservation Status Gray wolves have a conservation status of Least Concern, meaning that there is a large and stable population. Wolves were successfully reintroduced to Yellowstone National Park and parts of Idaho in 1995. They have been naturally recolonizing parts of their former range, moving into Washington and Oregon. In 2011, a lone male wolf made it to California. There is now a resident pack there. In the Great Lakes region, gray wolves are now thriving in Minnesota, Michigan, and now Wisconsin. One of the challenges of expanding gray wolf populations is that people continue to fear wolves, many farmers and ranchers consider gray wolves a menace to livestock, and hunters want the government to declare open season on gray wolves to stop them preying on game animals such as deer, moose, and elk. By the mid-1930s, most gray wolves in the United States had been killed. Today, the gray wolfs North American range has been reduced to Canada and parts of Alaska, Idaho, Michigan, Minnesota, Montana, Oregon, Utah, Washington, Wisconsin, and Wyoming. Mexican wolves, a gray wolf subspecies, are found in New Mexico and Arizona. Gray Wolves and Humans Wolves and human beings have a long adversarial history. Although wolves rarely attack humans, both wolves and humans are predators at the top of the food chain. As a result, they are often in conflict as habitats decline and wolves become more likely to attack livestock. Negative feelings toward wolves have been nurtured over the centuries through popular culture. Fairy tales such as Little Red Riding Hood represent wolves as vicious predators; these negative representations make it very difficult to present wolves as a species to be protected. Despite negative interactions, wolves are also seen as symbols of strength and icons of the wilderness. This may be one reason why there is an increased interest in keeping wolves or wolf/dog hybrids as pets- a practice which is rarely successful for the animal or its owner. Politics - Essay Example Swayed by the European lines of thought, these parties managed to grow in numbers since they appealed mostly to the oppressed people as well as the distressed workers in the country. They successfully managed to field candidates throughout the nation in numerous elected positions for the next several years. However, towards the beginning of the 1920ââ¬â¢s, these socialist movements faced severe resistance and condemnation from the government and eventually broke off the movement. The parties ceased to attract numbers to support its cause in the beginning of the early 20th century, though the Socialist Labor Party remained alive until the end of the 20th century. Socialism refers to a system whereby the ownership and control of majority of assets in a given country is granted to the central government. The United States, unlike other countries such as Japan and Germany, has not employed this system of running the economy. Though the system has worked very well in the above mentioned countries, the United States continues to thrive well without its enforcement. Politically, socialist parties in the United States began fairing very poorly in the run up to the general elections. For instance, in the year 2008, socialist candidates and their parties received less than two of the three socialist candidates (Caramani pg. 201). This is way below what other socialist candidates in other nations receive. In Germany for example, socialist parties gathered close to 50% of the total votes cast in each successive election since the 1970ââ¬â¢s. There are several theories, however, that explain this phenomena in United States politics or governance. The United States has never had a feudal system. Other nations have had hierarchical systems which was lead from the top by a supreme deity while at the bottom of the system lay the commoner. Such systems were discriminatory in nature since it gave too much power to the person at the top at the expense of the common man at the bottom.

Critically appraise the contribution of Michael Power's audit Essay
Critically appraise the contribution of Michael Power's audit explosion argument to our understanding of accountability - Essay Example However the arguments go further to claim that these assumed causes need further support and research to express that the audit expansion is not a UK phenomenon (Power, 2002:183). This paper will review the basic arguments of the of The Audit Society and reconsider the causes and consequences of the audit society. Introduction Financial auditing is a statistical practice which seeks to draw conclusions from a limited inspection of documents. These documents can be written representations or budgets. More so, the inspections can be on oral testimony and direct observation. Prior to the past traditional methods of auditing in the UK, auditing began to modify by acquiring a new broader context. This was the reason because, audit began to play a new task in both the political and the economic sector. From this point, auditing became broader and a more significant tool in the society (Reuchars, 2004:76). Causes of Audit Explosion During the 1980s, the public sector institutions were chara cterized by financial constraints. Due to this factor, auditing and inspection became highly valued and important tool of change. National Audit Office and The Audit Commission became outstanding forces in government by playing an evolving and intricate constitutional role in different ways. In the late 1990s, the pressure for change increased as well as the demand for inspection and monitoring finances (Power, 2002:183). In another word audit explosion was driven by political demands on behalf of the citizens, patients, taxpayers, students and others. The reason behind this force was to provide greater accountability and transparency of service by both the public a and the private sector. The other pressure that forced the explosion of auditing was the rise of quality assurance practices and related transformations in regulatory style. Consequences of Auditing The introduction of auditing as an agency of organizational change has no measured consideration of benefits as well as pos sible dysfunctional effects. Although cost compliance has been introduced, audit and related monitoring ideas continue to be understood critically. In this respect, it is reasonable to suggest that auditing is an ideology driven for disciplining and controlling both the public and the private sector, yet it is not because auditing is not an instrument of genuine accountability. Therefore, to analyze the consequences of auditing, it is important to focus on the development of understanding auditing deeply (Powe, 2004:27). This broader understanding of auditing is the performance measures and other forms of accounting which provide an auditable front stage of an organization. The first consequence of auditing is that many performance indicators are produced but are not edited. Such facts are evident, and the UK Audit Commission is actively shaping these performance measures to enable genuine audit and inspection. However, just because a performance measure is not audited does not mean that it was not designed with potential audibility in mind. Another consequence is the growing population of auditees. This fact brings out the evidence that shows how different games of compliance creativity are played around the audit

State of the Union Address Essay Example for Free
State of the Union Address Essay State Of the Union Address 2013 While President Obama will primarily focus on discussing the economy and jobs for Americans, here are five hot topics you can expect President Obama to address in his annual State of the Union address. 1. Immigration: With immigration reform picking up major traction, Obama will likely encourage continued bipartisan action to move towards comprehensive immigration reform. Current proposals by the Gang of Eight would bring about tough and fair reform for over 11 million undocumented immigrants to move towards citizenship. In 2007, the Congressional Budget Office rated the plan as generating $48 billion in additional revenue over 10 years, while costing about $23 billion in additional welfare and health care payments. 2. Foreign policy: From the security of U.S. diplomatic posts to the U.S. policy towards Syria, Obama should have lot to say about the countrys foreign policy agenda. It will be interesting to see if Obamaa speechwriters will address the recent breaking news out of North Korea, where a successful third nuclear test was reported. President Obama called the action a highly provocative act that demands swift and credible action by the international community against North Korea. Of note are quick condemnations from Russia, Britain, South Korea and the United Nations. Will Obama use primetime to address the recent actions? Is the Iranian nuclear program of greater concern than North Korea? 3. Drones: Obamas drone program came under fire since last weeks Senate hearing regarding counterterrorism adviser John Brennans nomination to become director of the CIA. Will Obama use tme to justify the administrations policy of deploying unmanned drones to kill Americans suspected of being Al-Qaeda allies? 4. Gun violence: Background checks have picked up significant momentum across party lines and Obama is well on his way to pushing for comprehensive gun control and gun violence prevention. The NRA has been very vocal about Second Amendment rights, and recent events have pushed gun violence into national spotlight. Is this issue big enough to address in his primetime address? Former Rep. Gabrielle Giffords, mother of slain Chicago teen Hadiya Pendleton, and a young girl from Newtown, Connecticut will be present inside the Chamber when Obama delivers his address. 5. Climate Change: Obama came out strong during his January inaugural speech on addresssing climate change. He expressed the need to deal with the threat of climate change, knowing that the failure to do so would betray our children and future generations. However, his address tonight will likely cover climate change as it relates to energy technology, new industries, and economic growth. With all these issues that need to be addressed, you can expect some mention of the above. Count his words and see how many times Obama addresses the above topics. But expect it all to be overshadowed by the big issue that has carried through Obamas tenure as president the economy, jobs and economic recovery.

Essay on Art as a Reflection of Life in Death in Venice -- Death in Ve
Art as a Reflection of Life in Death in Venice à à à Death in Venice explores the relationship between an artist, namely Gustave von Aschenbach, and the world in which he lives. Aschenbach, destined to be an artist from a young age, represents art, while his surroundings represent life. As the story unfolds, Aschenbach endeavors on a journey in an attempt to relinquish his position in society as an artist. Aschenbach wants to experience life, as opposed to merely reflecting upon it, as he has done for so many years. This attempted change of lifestyle can also be interpreted as a transition from the ways of Apollo to those of Dionysus, an archetype dating back to Nietzsche's Birth of Tragedy. Aschenbach's journey throughout Death in Venice can be seen as an artist's attempt to live life free from artistic interpretations. In the end, however, Aschenbach fails and his death shows that art is transient. Because of Aschenbach's failure to step down from his position as an artist and to become a part of life, it can be concluded that art is purely a reflection of life. Aschenbach's journey commences upon his encountering a stranger on a portico. "He was obviously not Bavarian." (Mann, 4) Aschenbach, never having ventured far from home, is intrigued by this foreigner who fails to give him the respect and reverence that he is used to as a renowned artist. For the first time in his life, Aschenbach is challenged. "So now, perhaps, feeling, thus tyrannized, avenged itself by leaving him, refusing from now on to carry and wing his art and taking away with it all the ecstasy he had known in form and expression." (Mann, 7) Aschenbach, acknowledging the challenge, resolves to travel. The new territory upon which he is to embark, t... ...be an artist is shown throughout his life, including in his last moments on the beach when he fears Tadzio's death. The irony of Ashenbach's demise emphasizes that art, as a reflection of life, is transient. "And before nightfall a shocked and respectful world received the news of his decease." (Mann, 73) Aschenbach has earned his place in history as an artist. But like all artists, he is replaced by his successors. Aschenbach's transition from an Apollonian way of life to a Dionysian one shows that art reflects life. In his case, art is nothing more than a reflection, and although beautiful and appreciated, it is not an essential element of life itself. à Works Cited "Mann, Thomas." Reflection of Freakonomics
Isaac Pack Mrs.. Buchwald AP com/microeconomics-chapter-4/">Microeconomics 18 August 2013 Freakishness Reflection/Response Initially, I was intrigued by the book based on its odd cover, an image of what appears to be a granny smith apple on the outside and an orange on the inside, and I found the contents far more interesting. The ââ¬Å"catchphraseâ⬠used is ââ¬Å"a rogue economist explores the hidden side of everythingâ⬠, and no other phrase could be more accurate.Steven D. Levitate, a professor of economics at the University of Chicago, roved the various uses for his field that I had never before realized. The first example of a use for economics that piqued my interest was the very first one in the book: criminology. Before reading this, I had assumed that the subject of economics was involved with nothing more than concepts like the elasticity of prices and interest rates. I was utterly shocked when Steven D.Levitate was able to conclude that the cause of the decrease in the crime rate was attributable to not the increase in gun laws, not the increase in policing, and not the aging population, but the Roe v. Wade case that eventually led to the legalization of abortions. Anyone could easily guess that unwanted children are much more likely to become criminals, but to link that fact to the idea that people could avoid having unwanted children and create a logical and reasonable statement regarding the decrease in crime was absurd yet brilliant. The second use for economics that caught my eye was the idea of the value of roared information. He used the instance of the ASK with the facts regarding real estate astoundingly well to prove a point. Not only were the random bits of facts [such as the mention of Clansmen calling a conversation a ââ¬Å"collaborationâ⬠] hilarious and entertaining, but they proved an impressive point: withheld information can drastically raise or lower value with ease. I never really pondered upon it before, but upon r eading and analyzing this statement, I came to be conscious and aware of it.

A Guide to Writing Japanese New Years Cards
.The Japanese send New Years cards (nengajo) rather than Christmas cards. If you want to send nengajo to your Japanese friends, here are common greetings and expressions you can write to wish them all the best for the new year. Happy New Year All the following expressions roughly translate as Happy New Year. Choose any of them to begin your card. The saying is listed in kanji, or Japanese letters, on the left and in Romajiââ¬âtheà writing of Japanese inà Romanà charactersââ¬âon the right. æËŽã â㠾ã â"㠦ã Šãâ 㠧㠨ã â ã âã â"ã â㠾ã ⢠à Akemashite omedetou gozaimasu.æâ" °Ã¥ ¹ ´Ã£ Šãâ 㠧㠨ã â ã âã â"ã â㠾ã ⢠à Shinnen omedetou gozaimasu.omedetou gozaimasu.è ¬ ¹Ã¨ ³â¬Ã¦â" °Ã¥ ¹ ´ à Kinga Shinnenæ è ³â¬Ã¦â" °Ã¥ ¹ ´ à Kyouga Shinnenè ³â¬Ã¦ £ à Gashouè ¿Å½Ã¦Ë ¥ à Geishunè ¬ ¹Ã£ââ㠧æâ" °Ã¥ ¹ ´Ã£ ®Ã£ Šåâ"Å"㠳ãââç⠳ã â"ä ¸Å ã â㠾ã ⢠à Tsutsushinde shinnen no oyorokobi o moushiagemasu. The rest of the expressions can be used as a greeting. Expressions and Phrases After the greeting, add words of thanks, requests for continued favor, or wishes for health. Here are some common expressions, though you can add your own words as well. The saying is presented first in English, then in kanji, and then in Romaji. Adding the Date When dating the card, use the word gantan (Ã¥â¦Æ'æâ" ¦) instead of the date that card was written. Gantan means the morning of Jan. 1; therefore, it is not necessary to write ichi-gatsu gantan. As for the year, the Japanese era name is often used. For example, the year 2015 is Heisei nijuugo-nen (Ã¥ ¹ ³Ã¦Ë Ã¥ ¹ ´), the 27thà year of the era, Heisei. Although nengajo are often written vertically, it is acceptable to write them horizontally. Addressing Cards When sending New Years cards from overseas, the word nenga (Ã¥ ¹ ´Ã¨ ³â¬) should be written in red on the front side along with a stamp and address. This way, the post office will hold the card and deliver it on Jan. 1. Unlike Christmas cards, nengajo shouldnt arrive before New Years Day. Write your name (and address) at the left side of the card. You can add your own message or draw the picture of the present years zodiacal animal (eto).à Who to Send Nengajou To The Japanese send nengajou not only to family and friends but also to classmates, coworkers, and even business partners. However, personal nengajou often play an important role in connecting people. There were many heart-warming stories about nengajou submitted to The Memorable Nengajou Contest (Nengajou Omoide Taishou). Here is the top prize-winning short story in kanji, followed by the story in Romaji. ãâ¬Å'Ã¥ ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ £Ã£ ¦Ã£ ªÃ£ââ㠧ã â¢Ã£ â¹Ã£â¬ Ã¦Ë ¨Ã¥ ¹ ´Ã£ â¹Ã£ââ°Ã§ § 㠟㠡㠨åÆ' ã å⡠ºÃ£ â"ã Ÿå å⦠æ ³Ã£ ®Ã¥ °âÃ¥ ¥ ³Ã£ Å'Ã¥ °â¹Ã£ ã Ÿãâ¬âæ ¯ è ¦ ªÃ£ â¹Ã£ââ°Ã¨â ²Ã¥â¦ æ⠾æ £âã â¢Ã£âÅ'ã⬠ä »Å ã ¯Ã© ¤Å è ·Ã¦â" ½Ã¨ ¨ 㠫ã âãââ¹Ã¥ ½ ¼Ã¥ ¥ ³Ã£â¬âÃ¥ ®Å¡Ã¦â¢âÃ¥Ë ¶Ã© «Ëæ ¡Ã£ââãââãâ 㠦ã â"㠾㠣ã Ÿå ½ ¼Ã¥ ¥ ³Ã£ââè ¦â¹Ã£ â¹Ã£ ã⬠ã â 㠡㠮çâ"â¦Ã©â¢ ¢Ã©â¢ ·Ã£ Å'è ª ¿Ã§ â è £Å"助å⠡㠨ã â"㠦éâºâ¡Ã£ £Ã£ Ÿãâ¬â Ã¥ ¹ ³Ã¥ â¡Ã¥ ¹ ´Ã© ½ ¢Ã¤ ºâÃ¥ æ ³Ã£ ®Ã¨ ª ¿Ã§ â Ã¥ ´Ã£â¬âÃ¥ å⦠æ ³Ã£ ®Ã¥ °âÃ¥ ¥ ³Ã£ Å'æ ¥ ½Ã£ â"ã â㠨ã âãâ 㠨㠯æ⬠ã Ë㠪ã âã Å'ã⬠å ½ ¼Ã¥ ¥ ³Ã£ ¯Ã¦ ¯Å½Ã¦â" ¥Ã¥â¦Æ'æ °â"㠫ãââ㠣㠦ã ãââ¹Ã£â¬â㠲ãââ¡Ã£ £Ã£ ¨Ã£ â"㠦é⺠¢Ã£âÅ'㠦æš ®Ã£ââ°Ã£ â¢Ã¦ ¯ è ¦ ªÃ£ ®Ã© ¢Ã¥ ½ ±Ã£ââç § 㠟㠡㠫è ¦â¹Ã£ ¦Ã£ âãââ¹Ã£ ®Ã£ â¹Ã£â¬â Ã¥ ä ¸â¬Ã¦Å"ËÃ¥ Šã °Ã£â¬ Ã¥ ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ ®Ã¦ ºâ"Ã¥ââ¢Ã£ ®Ã¨ © ±Ã© ¡Å'㠫㠪㠣ã Ÿãâ¬âã ãââ㠪ç § 㠟㠡㠮ä ¼Å¡Ã¨ © ±Ã£ «Ã¤ ¸ æ⬠è °Ã£ ã â 㠪é ¡â㠧å °â¹Ã£ ãââ¹Ã¥ ½ ¼Ã¥ ¥ ³Ã£â¬âç⠡ç â ãââ㠪ã âãâ¬âæ ¯ è ¦ ªÃ£ ¨Ã¤ ¸â¬Ã§ ·â㠫ã âã Ÿé Æ'ã ¯Ã£â¬ ä ½ Ã¥ ±â¦Ã£ââè » ¢Ã£â¬â¦Ã£ ¨Ã£ â"㠦ã â㠟㠨è žã âã Ÿãâ¬âÃ¥ ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ ©Ã£ âãâ 㠧㠯㠪ã â¹Ã£ £Ã£ Ÿã ®Ã£ ãâ ã â ãâ¬â 㠿ãââ㠪㠧ã â㠣ã ãâŠå ½ ¼Ã¥ ¥ ³Ã£ «Ã¥ ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ââå⡠ºÃ£ â¢Ã¤ ºâ¹Ã£ «Ã¦ ± ºÃ£â ã Ÿãâ¬âã Ÿã ã â¢Ã£ââ㠮å ¹ ¸Ã£ âºÃ£ «Ã¥âº ²Ã£ ¾Ã£âÅ'ãââ¹Ã£ â㠨ãââé ¡Ëã âãâ¬â ãâ¬Å'Ã¥Ë Ã£â 㠦å ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ââãââ°Ã£ £Ã£ Ÿãâ¬âÃ¥ ¤ §Ã¥Ëâ¡Ã£ «Ã© ¡ 㠫é £ ¾Ã£ £Ã£ ŸãâËãâ¬âã⬠ä »â¢Ã¤ ºâ¹Ã¥ §â¹Ã£â 㠯å ½ ¼Ã¥ ¥ ³Ã£ ®Ã¦ ºâ¬Ã© ¢Ã£ ®Ã§ ¬âé ¡â㠧å ¹â¢Ã£ Å'éâ"â¹Ã£ âã Ÿãâ¬â Ã¥ ¹ ´Ã¨ ³â¬Ã§Å ¶Ã£ ¯Ã£ â¢Ã£ ¹Ã£ ¦Ã£ ®Ã¤ º ºÃ£ââÃ¥ ¹ ¸Ã£ âºÃ£ «Ã£ â"㠦ã ãâÅ'ãââ¹Ã£â¬â Nengajou tte nan desu ka.
